Welcome to CebuJobs, , an online localized job board in Cebu that provides employment opportunities. This website is owned and operated by local corporation ConvertBetter. All users are provided with this service (the "website") subject to the following terms and conditions of use. Please read this carefully. By accessing this website and any pages thereof, users agree to be bound by this agreement. Furthermore, CebuJobs will be therefore referred to as "Company" or any of its subsidiaries in this agreement.

I. Specific Use of Service

Employers

Companies or corporations will otherwise be known in this agreement as "Employer" will be entitled to use the website to advertise job vacancies for free and/or create their own profile page on the website. Employer will be entitled to access their designated dashboard but agrees that all information obtained shall only be used for the sole purpose of obtaining and assessing the suitability of candidates. Employer acknowledges and agrees that it shall disregard any personal data received which are irrelevant to obtaining and assessing the suitability of candidates. Employers shall be solely responsible for the content and material contained in its profile and job listing.

A. Paid Services

The Company shall have the right to terminate any services to any Employer and remove any feature job post or advertisement posted on the website at the Company's sole discretion, without any compensation or recourse to the Advertiser in the event that the relevant Advertiser or the contents of the relevant advertisement is or are in breach of any of the provisions herein; whereas, in the event that the Company decides to remove an advertisement for any reasons not relating to any breach of the provisions herein, the Company may after deducting the fees charged for the period that the advertisement has been posted on the Web Site, refund the remaining fees (if any) to the Advertisers.

The Company also reserves the right to change the service fee or institute new charges or fees, as it deems appropriate. In the event that any Employer fails to pay the service fee or any other fees or charges due to the Company, the Company reserves the right to suspend or terminate the Employer's job listing or advertisement, without prejudice to all other rights and remedies. In this section, Advertiser refers to the party who wishes to purchase or feature a paid advertisement on the website.

Employers acknowledge that paid services such as Urgent Job Posts will be valid for thirty (30) calendar days upon the date of purchase. They must be applied immediately and cannot be applied on a later day, lest the Employer wishes to forfeit the validity of the purchase and the amount cannot be refunded.

The same terms and conditions apply to Featured Company Logos ("Featured Companies"). Upon the purchase of the bundle or marketing package, they are approved by the administrator and immediately to be displayed on the agreed upon date and advertising space on the job site. The validity of the purchased service will be valid for thirty (30) calendar days and will automatically be deactivated upon the completion of the said days. Renewal must be on the behalf of the Employer or unless a special contract or marketing campaign is agreed upon by the two parties.

B. Free Services

The Company shall also have the rights to terminate any services to any Employer who currently experience the free or trial job posting or advertisement package. It is under the company’s sole discretion to discontinue said services for the reasons that they could contain spam content which are harmful to the candidates’ well-being, wrong information, or said services to be contracted are illegal.

Employers acknowledge that free services such as Regular Job posts will be valid for a period of fifteen (15) calendar days upon the date of publication. Other job postings from the respective employer must then be moderated by the system administrator to follow the company’s agreement to the fair use of the service. Fair use includes the number of job postings that are allowable for each company, as this will avoid the monopolization of advertisement opportunity.

Candidates

Job seekers will further be referred as "Candidate" in this agreement. A candidate agrees that he/she shall only use the website for lawful purposes and seeking employment. A candidate may send his/her resume to any Employer who posts a job listing on or through the website. In such event, a candidate's resume will remain active on the website and will be stored in the Company's database at his/her own risk unless and until he/she chooses to delete it. Candidate acknowledges and agrees that his/her resume may be accessed by an Employer who has subscribed to the services of the Company for the sole purpose of obtaining and assessing the suitability of Jobseekers ("Employer"). The Company also reserves the right to edit any candidate's resume as it sees appropriate to achieve the purpose stated herein and to erase any personal data which the Company reasonably believes that such data are inaccurate having regard to the purpose (including any directly related purpose) for which the data are or are to be used.

Candidate acknowledges and agrees to the Company's practice of free access to the database and potential employee's resume and details for the sole purpose of obtaining and assessing the suitability as a potential employee. The Company will not release a candidate's personal data to any Employer without his/her permission. A candidate agrees that the Company and its associated companies may use his/her personal data (without his/her name, address and other personal identifiable information) for marketing purposes which may be directed to either potential employers or Employers, their respective agents or anyone under their employ. Candidate accepts that personal data given to Employer or other users are given entirely at his/her own risk.

II. Website Rules & Prohibitions

The Company reserves the right to terminate any services to any Employer or Candidate should it become aware of any breach by any Employers and/or Candidates.

Registration is required to use this website. Employers and candidates must provide correct and verifiable information upon registration. They are responsible for the safekeeping and confidentiality of your password, registration, and billing information. You are responsible for all the transactions with the Company made through your account or using your information whether it is authorized or not authorized by you. You agree to inform the Company of the misuse of your password, registration, and billing information immediately.

Users of the Service must agree to the following rules and prohibitions:

  • Users at all times must behave in good and moral standards towards all others.
  • All users will represent themselves in a truthful manner without perjury.
  • All users will avoid libelous, defamatory, unlawful, obscene, pornographic, offensive, abusive, threatening, or hateful actions on the website.
  • All users must not offer business opportunities for commissions-only jobs without the consent of the Company.
  • Employers must not offer pyramid schemes, or jobs that require recruitment of other members, sub-distributors, or agents.
  • Infringement on the copyright, trademark, trade secret or other intellectual property rights of others is strictly prohibited.
  • Candidates must represent only themselves and will not represent another person without that person's expressed written consent.
  • Communications will be limited only for the Company's marketing purposes unless otherwise stipulated in a feature ad or marketing opportunity for an Employer.
  • All users must avoid advertisement of services that are illegal and prohibited by these terms.
  • All users will provide the utmost respect to the Company and avoid the inclusion of information and/or links to websites that are competitors of the Company's website.
  • All users must circumvent information and/or links to other websites which contain information on illegal, prohibited practices, or contents that are prohibited on the Service.
  • All users must circumvent the outbreak of viruses, and/or "Trojan horses" or any other computer code, computer files or programs designed to interrupt, disrupt, destroy, or limit the functionality of any computer software or hardware if the case arises.
  • Users are not allowed to delete or revise any material on the Service that was posted by another person or entity, aggregate, copy, or duplicate information available on the Service and reverse engineering, deciphering, or decompiling the Service.
  • Users are not allowed to post irrelevant content, repeatedly post the same, similar, or unrelated content in different sections and/or categories, and/or put a disproportionately large load on the Company's website.
  • Users are not allowed to test or violate the security of the website. Any attempt to compromise the functionality of the service or the Company's system or network may result in civil or criminal liability. This includes, without limitation, sending malicious information, accessing data that is not intended for the public, attempting to breach security or authentication measures without proper authorization, attempting to probe or test the vulnerability of a system or network, forging any TCP/IP packet header or any part of the header information in any email or posting. Also prohibited are the sending, creating, and replying to "mail bombs" (sending large or multiple electronic messages to recipients with malicious intent) and flooding the system of the Company or its other users.
  • All users shall be responsible for their own communications and are responsible for the consequences of their posting. The Company does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other users or endorse any opinions expressed by users. Any reliance by users on material posted by other users shall be at their own risk. The Company reserves the right to expel any users and prevent their further access to the Company's Web Sites, at any time for breaching this Agreement or violating the law and also reserves the right to remove any material which is abusive, illegal, disruptive or inappropriate in the Company's sole discretion.

III. Copyright & Intellectual Property

CebuJobs and its images will be displayed only on the website are owned by the Company. Other contents of this website, such as text, graphics, images and other material are protected by copyright. No part or parts of the website may be reproduced, distributed adapted, modified, republished, displayed, broadcast, hyperlinked, framed or transmitted in any manner or by any means or stored in an information retrieval system without the prior written permission from the Company.

IV. Indemnity & Limitation of Liability

The Company will not be responsible or held liable in any way if any Employer, in breach of the Terms of Use Agreement. By accessing this website, you agree to defend, indemnify and hold harmless CebuJobs from and against any claims, actions or demands, alleging or resulting from your use of the website.

V. Governing Law and Jurisdiction

All users are responsible to ensure to comply with the laws, regulations and legislation of the Philippine government upon employment. This includes the responsibility to ensure candidates are of legal employment age and have the ability to apply for a job. This Agreement is governed by the laws of the Republic of Philippines and users hereby submit to the jurisdiction of the Philippine courts.

VI. Termination of Use

Violation of the Terms of Use Agreement is sufficient ground for immediate termination of the use of the service with or without prior notice or warning to the user (Employer and Candidate). The Company reserves the right to investigate and take legal action against anyone who violates the Terms or if any information submitted to the Company is unverifiable or cannot be confirmed. Certain provisions of the Terms will remain in effect even after you are no longer a User of the website. The Company reserves the right to be the sole interpreter of the Terms.
